EXAMINATION OF FUNDAMENTAL PROBLEMS ARISING FROM THE PRIOR CONVICTION PROVISIONS OF THE GUN CONTROL ACT OF 1968 AND SOLUTIONS ADVANCED FOR THEM BY THE COURTS.
Abstract
THE GUN CONTROL ACT OF 1968 PROHIBITS CONVICTED FELONS FROM PURCHASING OR POSSESSING FIREARMS. THE LACK OF A DEFINITION OF WHAT CONSTITUTES A FELONY AND TO WHAT EXTENT A DEFENDANT CAN LIMIT JURY KNOWLEDGE OF THE DETAILS OF HIS CRIMINAL RECORD BY STIPULATING TO HIS STATUS AS A CONVICTED FELON ARE STUDIED. THE AUTHOR STATES THAT CONGRESSS SHOULD CLARIFY THE ACT'S TREATMENT OF CONVICTED FELONS.
