Abstract
ELEMENTS OF DUE PROCESS INCLUDE THE NEED FOR A PRESENTENCE REPORT, BEFORE A SENTENCE IS PRONOUNCED, WHICH MEETS CERTAIN REQUIREMENTS. THE PROBATIONER HAS A RIGHT TO A HEARING ON NOTICE OF A CHARGE OF VIOLATION AND A RIGHT TO REFUSE PROBATION. STATE AND SUPREME COURT DECISIONS ARE DISCUSSED IN RELATION TO DUE PROCESS IN PROBATION.
