THE ISSUE OF UNWARRANTED GRAND JURY PUBLICATIONS PRIOR TO INDICTMENT IS EVALUATED IN RELATION TO THE HISTORIC AND CONSTITUTIONAL FUNCTION OF THE GRAND JURY AND PROPOSALS ARE MADE FOR DEALING WITH THIS PROBLEM.
Abstract
THE AUTHOR RECOMMENDS CLOSER JUDICIAL SUPERVISION OF THE GRAND JURY PROCESS; THE DISMISSAL OF AN INDICTMENT WHEN GRAND JURY MISCONDUCT IMPAIRS THE INTEGRITY THEREOF OR RESULTS IN PREJUDICE TO THE DEFENDANT; AND AN AMENDMENT TO THE CRIMINAL PROCEDURE LAW AUTHORIZING A FULL JUDICIAL INVESTIGATION OF ANY COMPLAINT MADE BY EITHER A WITNESS OR THE SUBJECT OF A GRAND JURY INVESTIGATION WHEN A LEAK OCCURS. PERTINENT COURT DECISIONS ARE CITED.
