This paper describes an instance of white collar crime and outlines some of the problems encountered by the investigator when attempting to reconstruct the offence and bring the offenders to justice.
Abstract
The analysis highlights several limitations in the criminal law and shows how offenders can manipulate loopholes in the law to their advantage. These loopholes exist in many instances, especially in the area of business crimes, because of a conflict between the rule of law and the social status of the offender on the one hand, and the peculiar ethics and practices of modern business associations on the other. A function of the paper is also to direct academic attention towards these problems as a focus for research. (Publisher abstract)
