RECOMMENDATIONS CONCERNING THE ROLE OF THE FAMILY COURT IN NEW YORK CITY IN DESIGNATING DETENTION FACILITIES FOR CHILDREN.
Abstract
THE PROPOSALS CONCERN DETENTION FACILITIES FOR DELINQUENT CHILDREN AND PERSONS IN NEED OF SUPERVISION (PINS), PROBATION, MENTAL HEALTH SERVICES, AND PLANNING OF PROCEDURES TO MEET THE NEEDS OF THE CHILD RATHER THAN THE AGENCY. SPECIFIC RECOMMENDATIONS INCLUDE THE PROVISION OF SERVICES FOR CHILDREN AND THEIR FAMILIES WITHIN THE COMMUNITY TO ENABLE A CHILD TO REMAIN AT HOME WHEN APPROPRIATE, AND THE ESTABLISHMENT OF ADDITIONAL NON-SECURE DETENTION FACILITIES FOR CHILDREN FOR WHOM A PETITION OF DELINQUENCY OR A 'PINS' HAS BEEN FILED. A FURTHER RECOMMENDATION CONCERNS MENTALLY ILL PERSONS WHO HAVE BEEN COVERED BY FAMILY COURT PROCEEDINGS. THE SUBCOMMITTEE POINTED OUT THE DEFICIT IN FUNDS AND STAFF IN THE OFFICE OF PROBATION, AND INDICATED THE NEED FOR QUALIFIED, PROFESSIONAL PERSONNEL FOR THE FAMILY COURT. IT WAS FOUND THAT PROCEDURES ARE OFTEN TAILORED TO THE CONVENIENCE OF AGENCIES. NUMEROUS RECOMMENDATIONS TO RECTIFY THESE PROCEDURES ARE INCLUDED.
