This volume presents an overview of Venezulan criminal procedure and evidence law.
Abstract
General evidentiary questions of proof in a criminal trial introduce basic concepts and definitions. Subsequent sections cover the procedural progression, beginning with the period for discovery, gathering evidence, and conducting investigations. Characteristics peculiar to Venezuelan evidence law are specifically addressed. The means of introducing evidence, its objectives, and classification, as well as the differences between criminal and civil standards of proof are discussed. Other topics include the probative value of evidence and its admissibility and relevance, the burden of proof, the plenary proceeding, the criminal trial, motions and pleas, and the procedure for appeal to review the facts and law. The second half of the book deals with declaration, witnesses' statements, and testimony, which are discussed in terms of probative value, contradiction, challenge, and withdrawal of confessions, as well as the means by which confessions are obtained. Also discussed are prosecutorial declarations (indictments), sworn testimony, spontaneous confessions, and in-court confessions and declarations. A bibliography of over 90 entries and an index are provided.
