Abstract
AN ADJUDICATION BY MEMBERS OF A BOARD OF VISITORS IS ORDINARILY THE ULTIMATE IN A RANGE OF INTERNAL MEASURES TO MAINTAIN DISCIPLINE AND CONTROL IN A CORRECTIONAL INSTITUTION. AS SUCH, THE HEARING IS CONDUCTED MUCH LIKE A TRIAL, OBSERVING THE RULES OF EVIDENCE. THE ADJUDICATORS ARE TOLD TO BEGIN EACH HEARING WITHOUT FIRST CONSULTING WARDEN REPORTS OR OTHER DOCUMENTS WHICH MIGHT PREJUDICE THEIR OPINION. PROCEDURES TO BE FOLLOWED WHEN THE INMATES PLEAD NOT GUILTY OR REFUSES TO PLEAD ARE GIVEN, TOGETHER WITH THE REPORTS REQUIRED IF THE NOT GUILTY PLEA IS SUSTAINED. MITIGATING CIRCUMSTANCES SHOULD BE CONSIDERED IF THE INMATE PLEADS GUILTY. THE RANGE OF PENALTIES WHICH MAY BE IMPOSED ARE REVIEWED AND THE APPROPRIATENESS OF EACH UNDER DIFFERING CIRCUMSTANCES IS DISCUSSED. AN APPENDIX CONTAINS A SAMPLE FORM FOR A LETTER TO THE ACCUSED EXPLAINING HIS RIGHTS DURING THE HEARING. (GLR)
