THE 1965 POST CONVICTION HEARING ACT (P.C.H.A.) WAS DESIGNED TO ESTABLISH A UNITARY PROCEDURE FOR PROVIDING RELIEF FROM CONVICTIONS OBTAINED AND SENTENCES IMPOSED WITHOUT DUE PROCESS OF LAW.
Abstract
PERTINENT CASE LAW IS CITED IN THIS PROCEDURE AND INFORMATION MEMORANDUM FOR COUNSEL REPRESENTING A POST CONVICTION PETITIONER SEEKING COLLATERAL REVIEW. COVERED ARE THE FILING OF THE PETITION, BAIL AND SUPERSEDERS PENDING POST CONVICTION REVIEW, WAIVER, AND FINAL LITIGATION.
