A MODEL LAW TO INSURE THE SECURITY AND PRIVACY OF CRIMINAL HISTORY RECORDS THAT ARE STORED IN ELECTRONIC DATA PROCESSING (EDP) CRIMINAL HISTORY INFORMATION SYSTEMS.
Abstract
THIS REPORT PRESENTS THE DRAFTING PHILOSOPHY, THE MODEL ACT, A SECTION-BY-SECTION ANALYSIS OF THE ACT AND A BIBLIOGRAPHY. WHILE THIS MODEL MAY BE APPLIED TO ANY CRIMINAL RECORD SYSTEM, IT IS ESPECIALLY ADAPTED TO EDP SYSTEMS. THE ACT CALLS FOR THE ESTABLISHMENT OF A CRIMINAL OFFENDER RECORDS CONTROL COMMITTEE WITH REPRESENTATIVES FROM STATE AND LOCAL CRIMINAL JUSTICE AGENCIES, AND FOR THE ESTABLISHMENT OF A SECURITY AND PRIVACY COUNCIL. ITS PURPOSE WOULD BE TO CONDUCT A CONTINUING STUDY AND REVIEW OF QUESTIONS OF INDIVIDUAL PRIVACY AND SYSTEM SECURITY. ACCESS TO INFORMATION WOULD ONLY BE ALLOWED TO BONA FIDE CRIMINAL JUSTICE AGENCIES FOR LEGITIMATE AND OFFICIAL BUSINESS. AGENCY ELIGIBILITY WOULD BE DETERMINED BY THE CONTROL COMMITTEE. ANOTHER IMPORTANT ASPECT OF THIS ACT IS THE PROVISION FOR THE INDIVIDUAL TO INSPECT HIS OWN CRIMINAL FILE AND, IF NECESSARY, TO CHALLENGE THE ACCURACY OF THE INFORMATION CONTAINED THEREIN.
