This paper provides proposals and contributions from various countries on the international protocol (legal instrument) against trafficking in persons, particularly women and children to the United Nations Ad Hoc Committee on the Elaboration of a Convention Against Transnational Organized Crime.
Abstract
This paper contains proposals and contributions from nine countries, the European community, and the Secretariat regarding the finalization and approval of the international protocol against trafficking in persons, especially women and children. Belgium requested additional clarification be added to the introduction on prostitution and the trafficking in persons. China proposed a new article to follow Article 10 examining measures to eliminate trafficking in women and children including using and strengthening bilateral and multilateral cooperation. The Holy See proposed additional information under Article 3, obligation to criminalize and an amendment to Article 4 on assistance for and protection of victims of trafficking in persons. Italy expressed its interest in strengthening the provisions concerning social assistance to and protection of victims and amendments to Article 3 (protection of human rights and social assistance), Article 4 (fair treatment and protection of trafficked persons), and Article 5 (residence status of trafficked persons). Japan proposed an amendment to Article 2 under definitions regarding child involvement. Mexico proposed new wording under Article 3, the obligation to criminalize, under Article 4, assistance for and protection of victims of trafficking in persons, change title to compensation and restitution to victims, under Article 5. It is proposed that Article 5 be merged under Article 4, and under Article 8, border measures, the title and text be replaced with training. The Phillippines proposed amendments under Article 10, prevention of trafficking in persons. The Syrian Arab Republic proposed an amendment to Article 3, the obligation to criminalize. Thailand proposed replacement of Article 11, cooperation with non-State parties, on the prevention and punishment of trafficking in persons and the protection of the rights and care for trafficked persons. The European community proposed a revision of Article 8, border measures and the Secretariat proposed replacing Article 14, relation with the convention, to establish a link between the protocol and the convention.
