This report contains proposals and contributions received by the Ad Hoc Committee on the Elaboration of a Convention Against Transnational Organized Crime from Belgium, South Africa, Spain, and Sweden.
Abstract
Belgium comments on Article IV of the draft Protocol Against the Illicit Manufacturing of and Trafficking in Firearms, Ammunition, and Other Related Materials, Supplementary to the United Nations Convention Against Transnational organized Crime. Belgium recommends that the Ad Hoc Committee give consideration to the insertion of a safeguard clause regarding international humanitarian law for situations that involve armed conflict, particularly domestic armed conflict within the meaning ascribed to those terms by international humanitarian law. South Africa's comments and proposals on the draft Protocol Against the Illicit Manufacturing of and Trafficking in Firearms, Ammunition, and Other Related Materials focus on the preambular section and articles that deal with the relationship with the United Nations Convention Against Transnational organized Crime; definitions; purpose; scope; criminalization; confiscation or forfeiture; record-keeping; marking of firearms; general requirements for export, import, and transit licensing or authorization system; and exchange of information. Spain's comments and proposals address articles that deal with money laundering and confiscation. Sweden's comments and proposals focus on the firearms protocol to the United Nations Convention Against Transnational Organized Crime.
