THE TRANSFER OF JUVENILE OFFENDERS FROM JUVENILE TO CRIMINAL COURT JURISDICTION IS DISCUSSED, AND THE INSTITUTE OF JUDICIAL ADMINISTRATION AND AMERICAN BAR ASSOCIATION STANDARDS FOR TRANSFERS ARE CRITICIZED.
Abstract
A JUVENILE COURT COUNSELOR DEFINES TRANSFER AND PROVIDES BACKGROUND INFORMATION ON THIS PROCEDURE. THEN, A JUDGE OF A JUVENILE AND FAMILY COURT DISCUSSES AND CRITICIZES SOME OF THE SUGGESTED STANDARDS, SUCH AS THOSE LIMITING SENTENCE LENGTHS, PLACING TIME CONSTRAINTS ON COURT ACTION FOR TRANSFERS, AND REQUIRING PREVIOUS ADJUDICATION BEFORE TRANSFERS, AND REQUIRING PREVIOUS ADJUDICATION BEFORE TRANSFERS MAY BE CONSIDERED. A WORKABLE TRANSFER STATUTE WOULD PLACE FEWER CONSTRAINTS ON THE COURT AND ALLOW MORE DISCRETION IN THE HANDLING OF INDIVIDUAL CASES. THE AUDIOTAPE CASSETTE IS SUITABLE FOR AN AUDIENCE WITH A PRIOR KNOWLEDGE OF THE STANDARDS. A TABLE OF CONTENTS IS INCLUDED, BUT FURTHER SUPPLEMENTARY MATERIALS ARE NOT PROVIDED.
