This handbook for Union County (New Jersey) school administrators reviews juvenile court procedures and practices and delineates the school's responsibilities and limitations in the areas of student interrogation, search and seizure, evidence control and custody, substance and child abuse, and record confidentiality.
Abstract
In addition to specifying juvenile court jurisdiction, the first section examines police diversion, juvenile detention, juvenile intake conferences, formal and informal judicial proceedings, and available dispositional options. Access to and use of court records in school administrative proceedings also are covered. Problems that may develop as a result of the interrogation of students who are charged and tried for juvenile delinquency are enumerated, and precautions that should be taken with evidence seized from a student and to be used in trial are outlined. Judicial decisions concerning school authority to conduct person, possession (e.g., pocketbooks), and locker searches are reviewed. Signs and symptoms of student substance abuse are listed to aid teachers and administrators in identification, and procedures to be followed in suspected drug abuse cases are detailed. The role of school personnel in the detection and reporting of child abuse also is examined. Finally, the requirements of the Family Educational Rights and Privacy Act of 1974 are explained, and State law concerning access to school records and remedies for denial of access are discussed. Law regarding retention, destruction, and correction of records also is reviewed. 27 notes.
