This manual and pocket reference card present guidelines for use by police officers in enforcing orders of protection for victims of domestic assault and explain immediate actions, referral actions and safety strategies, firearms seizure or removal, and the handling of interstate stalking or violation of an order of protection.
Abstract
The manual emphasizes that the Violence Against Women Act of 1994 requires jurisdictions to give full faith and credit to valid orders of protection issued by other jurisdictions. This provision requires police officers in the enforcing jurisdiction to comply with all laws, policies, and procedures of their own jurisdiction concerning violation of orders of protection. In addition, the failure to enforce a valid order of protection because it was issued in another jurisdiction may leave officers and police agencies vulnerable to liability. Immediate enforcement action should include ensuring the safety of all involved, seeking any needed medical attention, safeguarding the victim from further abuse, and other actions. Officers should also address victims' transportation and housing needs by making appropriate referrals and refer the victim to the issuing jurisdiction for the enforcement of economic provisions with in the order of protection.
