COMPARISON OF THE PROVISIONS OF INTERNATIONAL AGREEMENTS ON PRISONERS' RIGHTS WITH THOSE OF THE BELGIAN CONSTITUTION AND BELGIAN CORRECTIONS REGULATIONS ON THE SAME SUBJECT.
Abstract
THE INTERNATIONAL AGREEMENTS ON PRISONERS' RIGHTS ARE THE UNITED NATIONS UNIVERSAL DECLARATION OF THE RIGHTS OF MAN OF 1948, THE EUROPEAN CONVENTION ON SAFEGUARDING THE RIGHTS OF MAN OF 1950, AND THE UNITED NATIONS MINIMAL RULES FOR THE TREATMENT OF PRISONERS OF 1955. RIGHTS UNDER THESE AGREEMENTS AND UNDER BELGIAN LAW THAT ARE DISCUSSED INCLUDE THE RIGHT TO TREATMENT LEADING TO REHABILITATION, THE RIGHT TO DECENT LIVING CONDITIONS AND HEALTH CARE, TO WORK, COMPENSATION AND SOCIAL SECURITY, TO OCCUPATIONAL TRAINING, TO PRIVACY, TO VISITORS, TO CORRESPONDENCE, TO FREEDOM OF EXPRESSION, IDEAS AND RELIGION, AND THE RIGHT TO COMPLAIN AND HAVE ONE'S COMPLAINTS HEARD. THE AUTHOR CONCLUDES THAT PRISONERS' RIGHTS IN BELGIUM, BY AND LARGE, ARE IN CONFORMITY WITH THOSE LAID DOWN IN THE INTERNATIONAL AGREEMENTS. HE ADDS, HOWEVER, THAT EVERYTHING DEPENDS ON HOW THE REGULATIONS ARE APPLIED IN PRACTICE, SINCE PRISONERS DO NOT HAVE SUFFICIENT GUARANTEES THAT THE REGULATIONS WILL BE RESPECTED. --IN FRENCH
