AN ACT TO PROVIDE IMPLEMENTATION PROCEDURES FOR OFFENDER TRANSFER TREATIES WITH MEXICO AND WITH CANADA IS EXPLAINED. THE ACT ALSO WOULD PROVIDE PROCEDURES FOR ANY FUTURE PRISONER TRANSFER TREATIES.
Abstract
THIS IS THE FULL TEXT OF THE REPORT ISSUED BY THE COMMITTEE ON THE JUDICIARY, HOUSE OF REPRESENTATIVES, CONCERNING A BILL WHICH HAD PASSED THE SENATE. THE BILL DETAILS BOTH LEGAL PROCEDURES AND ADMINISTRATIVE PROCEDURES FOR THE TRANSFER OF AMERICANS HELD IN FOREIGN PRISONS AND FOREIGNERS HELD IN AMERICAN PRISONS. THIS COMMITTEE REPORT GIVES THE BACKGROUND OF THE BILL, REPRINTS THE TREATIES WITH CANADA AND WITH MEXICO, AND GIVES A HISTORY OF THE PROPOSED LEGISLATION. THEN THE MAJOR PROVISIONS OF THE BILL ARE SUMMARIZED. THIS IS FOLLOWED BY A SECTION-BY-SECTION ANALYSIS. A GREAT DEAL OF ATTENTION IS PAID TO PROTECTION OF CIVIL LIBERTIES OF AMERICAN PRISONERS AFFECTED BY THE TRANSFER. LETTERS AND SELECTED PASSAGES OF TESTIMONY URGING SUPPORT ARE INCLUDED. A SEGMENT DETAILS THE ANTICIPATED COSTS OF THE PROPOSED TRANSFERS. AS REQUIRED BY HOUSE RULES, THE FINAL SECTION SHOWS CHANGES IN THE UNITED STATES CODE WHICH WOULD BE BROUGHT ABOUT BY THIS BILL; IT WOULD ADD A NEW CHAPTER TO TITLE 18. (GLR)
