In this article, the authors pursue the question of whether the Racketeer Influenced and Corrupt Organizations Act - known as RICO - was intended to apply to public entities.
Abstract
The authors' major point is that they are convinced that Congress could (under the commerce clause) and did (within the four corners of the Act) include public entities within the term 'enterprise'. For readers who are unfamiliar with RICO, this piece may serve as a general introduction to the law. (Publisher abstract)
