This booklet examines why and how offenders are punished in the South African criminal justice system.
Abstract
Punishment has various objectives: retribution, rehabilitation, deterrence, incapacitation, and reparation. In South Africa, courts have the options of imposing the death sentence, imprisonment, committal to an institution, fines, corporal punishment, community service orders, correctional supervision, postponed and suspended sentences, compensation orders, and forfeiture. Convicted juveniles can be sentenced to all of these punishments, with the exception of the death penalty. Alternatively, convicted juveniles can be whipped, sent to reform school, or placed under the supervision of a probation officer or other guardian.
