REORIENTATION FROM PUNISHMENT TO TREATMENT IN CRIMINAL POLICY AND CRIMINAL LAW HAS BEEN EXPOSED TO HARSH CRITICISM.
Abstract
SOME OF THE MOST WEIGHTY ARGUMENTS USED TO PROVE THAT THE TREATMENT IDEOLOGY IS CONTROVERSIAL FROM THE PROFESSIONAL AS WELL AS ETHICAL POINTS OF VIEW ARE OUTLINED AND REFUTED. SPECIAL ATTENTION IS PAID TO THE ARGUMENT THAT TREATMENT ENDANGERS THE PRIVACY AND PERSONAL FREEDOM OF THOSE SUBJECTED TO IT, AND TO THE DIFFERENCE BETWEEN CONDITIONING ACCORDING TO BEHAVIORIST THEORY AND THE PSYCHODYNAMIC CONCEPTS OF TREATMENT IS EMPHASIZED. IT IS POINTED OUT THAT BEHAVIORIST CONCEPTS HAVE BEEN EVALUATED AS MANIPULATIVE AND PROBLEMATIC FROM BOTH THE ETHICAL AND PROFESSIONAL POINT OF VIEW AND ARE REMINISCENT OF THE CLASSICAL RETRIBUTIVE ORIENTATION. PSCHODYNAMIC APPROACHES, IT IS SUGGESTED, ARE MORE ACCEPTABLE SINCE THE ACTIVE PARTICIPATION AND COOPERATION OF THE PERSON TO BE TREATED IN THE CORRECTIVE PROCESS IS ANTICIPATED AND EXPECTED.
