This is the 2005-06 Annual Report of the Queensland Law Reform Commission (Australia), which is an independent statutory body charged with reviewing Queensland law with a view toward its systematic development and reform.
Abstract
In October 2006, the Attorney General and Minister for Justice asked the Commission to review Queensland's guardianship laws, which regulate the making of decisions by and on behalf of adults with impaired decisionmaking capacity. This Annual Report outlines the Commission's terms of reference for this review and reports on the first stage of the review, which involves an examination of the confidentiality provisions of guardianship legislation. In 2004, the Commission received a reference to review Queensland's Peace and Good Behaviour Act 1982, which pertains to protection of the community from breaches of the peace. This Annual Report outlines the terms of reference for the review and summarizes a Commission discussion paper released in March 2005 regarding the provisions of the Peace and Good Behaviour Act. The Commission continued to lead the Uniform Succession Laws Project, which involves the development of uniform succession laws for the Australian States and Territories. Topics addressed pertain to wills, the administration of estates of deceased persons, and other matters related to the estates of deceased persons. Other legislative matters discussed in this Annual Report are a review of the Uniform Evidence Acts and the law on the final disposal of a dead body. Commission personnel activities are also reported. Appendixes address legislative action on reports, a list of commission publications and working papers, a commission membership list, financial information, and a statement of Commission affairs for 2005-06.
