AN ANALYSIS OF PAROLE VIOLATION REPORTS FOR 9,563 MALE FELONS IN CALIFORNIA SHOWS THAT 9 OF THE 15 CONDITIONS ARE SO SELDOM VIOLATED THAT THEY COULD BE DROPPED WITHOUT AFFECTING PAROLE EFFECTIVENESS.
Abstract
THE 2-YEAR STUDY COVERED ALL PAROLE VIOLATION REPORTS FOR THE YEARS 1971 AND 1972. IT FOUND 31 PAROLE VIOLATION PATTERNS, 25 OF WHICH INCLUDED AT LEAST 1 OF 4 MAIN CONDITIONS--VIOLATION OF THE 'LAW' CONDITION (ESPECIALLY VIOLATIONS OF PROPERTY, NARCOTICS, AND MISDEMEANOR LAWS), ABUSE OF ALCHOL, DRUG ABUSE, AND FAILURE TO FILE REPORTS TO NOTIFY THE PAROLE OFFICE OF CHANGE OF RESIDENCE. THREE OTHER PATTERNS INVOLVED THREE CONDITIONS OF PAROLE CHARGED ALONE AND RARELY IN COMBINATION--VIOLATION OF THE WEAPONS CONDITION, PERSONAL ASSAULT, OR VIOLATION OF LAWS AGAINST AGGRESSION. BORDERLINE CHARGES WERE ASSOCIATION WITH QUESTIONABLE COMPANIONS AND FAILURE TO COOPERATE WITH THE PAROLE OFFICE. NINE CHARGES OCCURRED SO INFREQUENTLY THE REPORT RECOMMENDS THEY BE DROPPED AS PAROLE CONDITIONS: FAILURE TO REPORT DIRECTLY TO A TREATMENT PROGRAM, FAILURE TO BE GAINFULLY EMPLOYED, USE OF ALCOHOL OR DRUGS, OPERATING A MOTOR VEHICLE WITHOUT PAROLE OFFICER'S APPROVAL, ASSOCIATING WITH QUESTIONABLE COMPANIONS, FAILURE TO COOPERATE WITH THE PAROLE OFFICER, ENGAGING IN OCCUPATIONS WHICH HAVE BEEN RESTRICTED DUE TO FELON'S LOSS OF CIVIL RIGHTS, FAILURE TO REPAY CASH ASSISTANCE, AND SPECIAL CONDITIONS. TABLES AND CHARTS ILLUSTRATE STUDY DATA. A LIST OF 22 REFERENCES ARE INCLUDED.
