THIS MANUAL OF RECOMMENDED PROCEDURES FOR CALIFORNIA'S JUVENILE TRAFFIC COURTS WAS PREPARED BY THE CALIFORNIA JUVENILE TRAFFIC COURTS ASSOCIATION.
Abstract
THE GOAL OF THE MANUAL IS TO PROVIDE UNIFORM, CONSISTENT METHODS FOR DEALING WITH THE JUVENILE TRAFFIC OFFENDER. THE MANUAL PRESENTS THE MECHANICAL STEPS IN COURT PROCEDURES BUT IS NOT INTENDED AS A FINAL DISPOSITIONAL GUIDE. IT BEGINS WITH A DESCRIPTION OF THE JURISDICTION AND AUTHORITY OF THE TRAFFIC HEARING OFFICER. NEXT, THE FOLLOWING ASPECTS OF ADJUDICATION ARE DISCUSSED: THE HEARING ROOM, WRITTEN NOTICE TO APPEAR WITH A PARENT, MANDATORY APPEARANCE POLICIES, PRELIMINARY PROCEDURES, AND CONTESTED HEARINGS. THE SECTION ON DISPOSITIONS DISCUSSES USE OF THE MINOR'S DRIVING HISTORY, ALTERNATIVE DISPOSITIONS (ASSESSMENT, TRAFFIC SCHOOL, PROOF OF CORRECTION, WORK, SUSPENSION OF LICENSE, SPECIAL PROGRAM, PROBATIONARY SUPERVISION OR ORDERS), AND NOTICE AND ENFORCEMENT OF ORDERS. SUBSEQUENT SECTIONS DISCUSS REHEARINGS AND PROCEDURES IN CASES WHERE THE DEFENDANT FAILS TO APPEAR. FORMS USED, CORRESPONDENCE FROM STATE OFFICIALS, AND AN APPENDIX PRESENTING ADDITIONAL FORMS AS WELL AS DISCUSSIONS OF VARIOUS DRIVER EDUCATION PROGRAMS ARE INCLUDED. (CFW)
