The Illinois Code of Judicial Conduct is examined to identify the limits on and allowable latitudes for a judge's conduct on incidental ethical questions and to specify how the new Code affects a judge's judicial, civic, personal, charitable, and political roles.
Abstract
The article specifies permissible judicial conduct in a judge's relationship with attorneys, a judge's responsibility regarding accepting gifts, bequests, favors or loans from lawyers who practice or have practiced before him, and caveats on ex parte communications. The article also details when a judge must disqualify himself from future consideration of a case and how he may resume hearing the case if a remittal of disqualification is signed by all parties and lawyers in the case acting independently of any influence by the judge. Also discussed are the judge's right to withdraw from a case, appropriate judicial conduct while on the bench, the impact of judges' sexual transgressions, appropriate judicial behavior regarding political activities and campaigns, and the appropriate judicial response on learning that a fellow judge has violated a rule of judicial conduct. The article outlines those activities a judge may affirmatively carry out as a citizen; as a family fiduciary; as a supervisor; and as a writer, teacher, and lecturer. 151 footnotes.
