A SURVEY OF VARIOUS TYPES OF PRISONER GRIEVANCES AND THEIR POSSIBLE REMEDIES.
Abstract
THERE ARE FOUR TYPES OF RIGHTS THAT PRISONERS SEEK TO ESTABLISH - THE RIGHT TO PHYSICAL SECURITY, THOSE RIGHTS USUALLY TERMED 'CIVIL RIGHTS', SUCH AS FREEDOM OF RELIGION, FREEDOM OF SPEECH, ETC, THE RIGHT TO HAVE ACCESS TO THE COURT, AND THE RIGHT TO REASONABLE STANDARDS AND PROCEDURAL PROTECTIONS WHEN DECISIONS ARE MADE EFFECTING THE PRISONER. REMEDIES SUCH AS CIVIL SUITS AGAINST OFFICIALS, MANDAMUS, AND CLASS ACTIONS ARE DISCUSSED, AS WELL AS METHODS FOR REGULATING THE DISCRETION OF PRISON ADMINISTRATORS AND NON-JUDICIAL ALTERNATIVES FOR RESOLVING GRIEVANCES.
