WITHIN THE FRAMEWORK OF THE WEST GERMAN LAW REFORM AND COURT REORGANIZATION, THE DUTIES OF COURT CLERKS IN THE CITY OF HAMBURG WERE RESTRUCTURED, ESPECIALLY WITH REGARD TO PRELIMINARY HEARINGS AND MAIN TRIAL SESSIONS.
Abstract
THIS ARTICLE DESCRIBES IN DETAIL THE CHANGES IN THE DUTIES OF COURT CLERKS WITHIN THE CRIMINAL COURT SYSTEM OF HAMBURG CAUSED BY THE ONGOING CRIMINAL LAW AND COURT REFORM IN WEST GERMANY. SOME OF THE CHANGES INVOLVE A REDUCTION IN THE WORKLOAD OF THESE COURT OFFICERS; OTHERS HAVE ADDED TO SOME OF THEIR DUTIES. CASES IN POINT ARE THE WORK CONNECTED WITH PRELIMINARY HEARINGS AND MAIN SESSIONS OF CRIMINAL TRIALS. THE REPLACEMENT OF SHORT PRISON SENTENCES UP TO 6 MONTHS WITH FINES HAS RELIEVED MAGISTRATES OF PART OF THEIR CASELOAD. OTHER CHANGES IN THE DUTIES OF COURT CLERKS RELATE TO THE EXECUTORY PROCESS, PRISON SENTENCES, AND FINES. THE GENERAL OBJECTIVE OF THESE CHANGES IS TO ALLOW MAGISTRATES MORE TIME FOR THE PERFORMANCE OF THEIR MOST IMPORTANT WORK, I.E., REPORTING ON THE MAIN TRIAL PROCEEDINGS. --IN GERMAN.
