SCOPE AND NATURE OF DETAINER PROCESS WITH RECOMMENDATIONS FOR IMPROVEMENT.
Abstract
THIS PAPER IS THE RESULT OF A RESEARCH PROJECT UNDERTAKEN BY THE CENTER FOR CRIMINAL JUSTICE AT THE HARVARD LAW SCHOOL. IT EXAMINES THE DIFFERENT TYPES OF DETAINERS, OPERATION OF THE SYSTEM, AND THE EFFECTS OF DETAINERS ON THE PRISONER AND THE CRIMINAL JUSTICE SYSTEM. A VARIETY OF MEANS ARE SUGGESTED BY WHICH THE EXISTING SYSTEM CAN BE IMPROVED AND THE NEED FOR MANY DETAINERS ELIMINATED. ALSO STRESSED IS THE NEED FOR A CHANGE IN ATTITUDE BY CRIMINAL JUSTICE PERSONNEL, SO THAT DETAINERS ARE CONSIDERED MORE ON THEIR MERITS AND LESS ON THEIR TITLES.
