Suggestions for appellate procedure reforms are offered.
Abstract
This report, written by an independent organization which assists victims of miscarriages of justice, recommends reforms to the appellate procedures and the practices of the Court of Appeal. It also suggests a number of changes to the appellate procedures for summary convictions. Reform measures discussed include reforms to the leave procedures, removal of the time loss rule, improvements in the procedures for renewing applications, and the development of a checklist in the form of statutory guidance on those matters which the Court must consider. Also discussed in the report is the creation of a Criminal Cases Review Authority, including proposed operating principles and authority, organization and management structure, and estimated operating costs.
