This report presents the organization of the second session of the United Nations Ad Hoc Committee on the Elaboration of a Convention Against Transnational Organized Crime (held in Vienna on March 8-12, 1999), a summary of the Committee's discussion on the draft Convention, a summary of the discussion on the additional international legal instrument on trafficking in women and children, and adoption of the Committee's report on its second session.
Abstract
The Committee was established by the U.N. General Assembly in its Resolution 53/111 of December 9, 1998. The Committee's mandate is to draft the main text of the Convention, as well as of international instruments to address trafficking in women and children; combating the illicit manufacture of and trafficking in firearms, their parts and components, and ammunition; and illegal trafficking in and transporting of migrants, including by sea. The Committee based its work on a document that contains the draft U.N. Convention Against Transnational Organized Crime and on proposals and contributions submitted by governments. The Committee concluded its discussion on Article 1; the agreed-upon text was included in the new version of the draft Convention. Articles 2 and 3 were also discussed. The comments and proposals made during the second session are reflected in the revised version of the draft Convention. The Committee also completed a first reading of Articles 24 to 30 of the draft Convention. The comments and proposals made during the second session are reflected in the revised text of the draft Convention. The Committee requested the U.N. Secretariat to conduct an analytical study of provisions of national laws relevant to the Convention concerning offenses punishable by deprivation of liberty, with an indication of the number of years of imprisonment. The discussion on the additional international legal instrument on trafficking in women and children was based on a document that contains the revised draft Protocol to Prevent, Suppress, and Punish Trafficking in Women and Children, Supplementing the United Nations Convention Against Transnational Organized Crime.
