THIS REPORT SUMMARIZES NUMEROUS PROCEDURAL REFORMS IN THE AREA OF CRIMINAL CASE PROCESSING, FOCUSING ON NEEDED CHANGES IN NEW YORK CITY COURT OPERATIONS.
Abstract
SUBSTANTIVE RECOMMENDATIONS RELATING TO THE CONDUCT OF CRIMINAL TRIAL PROCEDURES AND IMPACTING ON COURT ADMINISTRATION, THE PROSECUTION, DEFENSE SERVICES, AND LEGISLATIVE ACTION ARE PRESENTED. ALSO INCLUDED ARE DESCRIPTION OF SPECIFIC PROPOSALS RECEIVING RESEARCH ATTENTION IN THE AREAS OF PROSECUTION, DEFENSE, AND COURT SYSTEM ADMINISTRATION. THE SOLUTIONS PROPOSED ARE INTENDED TO BE INTEGRATED WITH EACH OTHER TO FORM A COHESIVE APPROACH TO THE PROBLEM OF CASE PROCESSING. WHILE THE SUGGESTIONS DO NOT REQUIRE THE MASSIVE INFUSION OF NEW FUNDS, THEY DO NECESSITATE A COMPLETE RESTRUCTURING OF THE CRIMINAL JUSTICE SYSTEM. INDIVIDUAL REFORM PROPOSALS CALL FOR UNIFIED ADMINISTRATION OF THE COURTS, ANALYSIS AND EVALUATION OF CASE MANAGEMENT AND CALENDARING PROCEDURES, DISPUTE RESOLUTION CENTERS, CONTINUITY OF BOTH, BOTH DEFENSE AND PROSECUTION REPRESENTATION, PRETRIAL DIVERSION, DECRIMINALIZATION, CRIMINAL PROCEDURE REVISION, AND FIREARMS CONTROL. SOME OF THE RESEARCH AREAS IDENTIFIED INCLUDE THE UTILIZATION OF A COURT ADMINISTRATOR, INTENSIFIED PROSECUTION FOR MAJOR FELONIES, A PRETRIAL SERVICES AGENCY, AND PROFESSIONAL AND PARAPROFESSIONAL DEFENSE PERSONNEL TRAINING...ELW
