ARTICLE DISCUSSES APPLICATION OF LAW AND CRIMINAL JUSTICE FROM THE CONSENSUS MODEL TO THE CONFLICT-REPRESSION MODEL.
Abstract
THERE ARE THREE PERSPECTIVES THROUGH WHICH LAW AND JUSTICE HAVE BEEN EXAMINED: THE CONSENSUS MODEL, THE PLURALISTIC MODEL, AND THE CONFLICT-REPRESSION MODEL. THE CONSENSUS MODEL HOLDS THAT THE LAW REFLECTS THE COLLECTIVE WILL OF THE PEOPLE. IN THE PLURALISTIC MODEL, SOCIETY IS VIEWED AS COMPOSED OF DIVERSE SOCIAL GROUPS WHOSE INTERESTS, AT TIMES, CONFLICT. THE CONFLICT-REPRESSION MODEL CONTENDS THAT THE STATE IS USED BY SOME IN SOCIETY TO ENFORCE THEIR POWER ON OTHERS. THE AUTHORS EXPRESS HOW THESE IDEALS ARE PROPOUNDED AND SPREAD, AND STATE THEIR BELIEF THAT THE CONFLICT-REPRESSION MODEL IS THE ONE THAT HOLDS SWAY IN CAPITALIST AMERICA....BS
