Abstract
A BASIC THEME UNDERLYING ALL THE ESSAYS IS THE NEED FOR REFORM IN THE CRIMINAL JUSTICE SYSTEM STATED BY SPECIALISTS IN CRIMINAL LAW AND PROCEDURE. AFTER A BRIEF FOREWORD AND AN ESSAY OF APPRECIATION, THE BOOK EXAMINES VARIOUS FACETS OF ENGLISH COMMON LAW AND CRIMINAL LAW, AS WELL AS THE NEED FOR SENTENCING REFORM IN THE UNITED STATES. UNDER THE GENERAL CATEGORY OF ENGLISH CRIMINAL LAW, SUCH AREAS AS THE FORM AND FUNCTION OF CRIMINAL LAW, USES AND MISUSES OF THE JURY, CRIMINAL INTENT, AND SITUATIONAL LIABILITY ARE EXAMINED. SPECIFIC CRIMINAL ACTS INCLUDING SEXUAL OFFENSES, CRIMINAL LIBEL, AND THEFT ARE ANALYZED AND REFORMS IN THE LAWS ARE PROPSDED. THE RIGHTS OF THE ACCUSED ARE DISCUSSED IN RELATION TO QUESTIONING AT A POLICE STATION. THE INTEGRITY OF CRIMINAL PROSECUTIONS, SENTENCING AUTHORITY, A PLEA FOR SHORTER SENTENCES, AND SENTENCING REFORM IN AMERICA ARE ALSO EXPLORED. MOST ARTICLES HAVE EXTENSIVE FOOTNOTES.
