NCJ Number
145298
Date Published
1991
Length
8 pages
Annotation
This resolution by the United Nations General Assembly adops the Model Treaty on the Transfer of Proceedings in Criminal Matters, as a framework that could aid countries interested in negotiating and concluding bilateral or multilateral treaties aimed at improving cooperation in matters of crime prevention and criminal justice.
Abstract
The model treaty states that countries should enact the necessary laws to ensure that it can respond to a request by another country to undertake appropriate proceedings related to an offense committed in the country. Requests to take proceedings should be made in writing. The request, supporting documents, and subsequent communication should be transmitted through diplomatic channels, directly between the Ministries of Justice, or any other authorities designated by the countries. Several grounds exist for refusal of a request. Additional provisions and footnotes
