The United Nations General Assembly adopted, in 1991, a model treaty on mutual assistance in criminal matters.
Abstract
Mutual assistance to be provided in accordance with this treaty could include taking evidence or statements, assisting in the availability of detained persons, effecting service of judicial documents, executing searches and seizures, examining objects and sites, and providing information and evidentiary items. The treaty does not apply to the arrest or detention of a person with a view toward extradition, the enforcement in the requested State of criminal judgments imposed by the requesting State, the transfer of persons in custody to serve sentences, or the transfer of proceedings in criminal matters. Treaty articles deal with the execution of requests, return of material to the requested State, protection of confidentiality, the right to decline to give evidence, and rules of safe conduct.
