THIS PUBLICATION DISCUSSES THE PHILOSOPHY, HISTORY, AND LEGAL ASPECTS OF JUVENILE RESTITUTION, COMPONENTS OF RESTITUTION PROGRAMS, ISSUES IN RESTITUTION, AND RESTITUTION PROGRAMS IN WISCONSIN AND THE U.S.
Abstract
THE PUBLICATION IS INTENDED FOR THOSE WISHING TO LEARN ABOUT RESTITUTION OR TO DESIGN A LOCAL RESTITUTION PROJECT. THE RENEWED INTEREST IN RESTITUTION RESULTS FROM RECOGNITION OF THE VICTIM'S IMPORTANCE, DISILLUSIONMENT WITH TRADITIONAL ALTERNATIVES, AND A PHILOSOPHICAL SHIFT TOWARD ASSOCIATING DISPOSITIONS WITH OFFENSES. JUVENILE RESTITUTION AIMS TO RESTORE THE LOSS TO VICTIMS AND TO SATISFY VICTIMS THAT OFFENDERS ARE BEING HELD ACCOUNTABLE FOR THEIR ACTIONS. THE NEW WISCONSIN CHILDREN'S CODE EXPLICITLY MENTIONS RESTITUTION IN TWO SECTIONS. LOCAL RESTITUTION STAFFS MUST DETERMINE ELIGIBILITY FOR RESTITUTION, PROGRAM FOCUS, AND AMOUNT AND TYPE OF RESTITUTION. PROGRAM COMPONENTS INCLUDE FUNDS, PROJECT STAFF, VOLUNTEERS, COMMUNITY BOARD, PUBLIC RELATIONS EFFORTS, VICTIM INVOLVEMENT, JOB AND COMMUNITY SERVICE SITES, LIABILITY INSURANCE, AND EVALUATION EFFORTS. CURRENT CONCERNS ABOUT RESTITUTION CENTER ON WHETHER RESTITUTION INVOLVES MORE YOUTH WITH THE JUVENILE JUSTICE SYSTEM, THE AMOUNT OF PAPERWORK INVOLVED, WHETHER RESTITUTION IS TOO LENIENT, EFFECTS ON OFFENSES, AND SANCTIONS FOR YOUTH WHO DO NOT COMPLY WITH RESTITUTION AGREEMENTS. LEAA HAS FUNDED 86 RESTITUTION PROGRAMS IN THE U.S. FOOTNOTES, A LIST OF WISCONSIN RESTITUTION PROGRAMS, AND EXTENSIVE APPENDIXES PRESENTING RELEVANT LEGISLATION, COURT DECISIONS, FORMS, A LIST OF WISCONSIN CIRCUIT COURT JUDGES, BROCHURES FROM RESTITUTION PROGRAMS, RESOURCE PLACES, AND APPROXIMATELY 130 REFERENCES ARE INCLUDED.
