This book advocates applying the values of restorative justice in the regulation of behavior in other institutions upon which a society is based in addition to the criminal justice system.
Abstract
The book brings together the author's extensive work on and advocacy for both restorative justice and responsive regulation of behavior in business enterprises. In the latter domain, the author has focused on occupational health and safety, environmental protection, and nursing home regulation. The book first reviews the values of restorative justice and the persistence of these values throughout history and cultural development, with attention to the resurgence of restorative justice values throughout the world in recent years. In applying restorative justice values across the many domains of human institutions that impact the lives of people, the focus of the book is on how to deal with the harms these institutions may cause to individuals and society in the course of performing their activities and delivering their services. The book's focus is on how the values of restorative justice - addressing the harms to victims, changing perpetrators' harmful behavior, and preventing similar harmful behaviors in the future - can be implemented in the regulatory systems that govern the normative institutions of a society. One chapter reviews the empirical evidence regarding whether or not restorative justice works in effectively remedying and preventing harms to individuals and communities. Another chapter considers theories that might explain why restorative justice is effective in remedying harms across the broad spectrum of national and international interactions. "World Peacemaking" is addressed in another chapter, followed by chapters that discuss restorative justice in "sustainable development" and "transforming the legal system."
