Based on the litigation experiences of the editors and chapter authors under the Racketeer Influenced and Corrupt Organizations Act (RICO), this book is a practical guide to all aspects of RICO litigation, both civil and criminal.
Abstract
Seven of the 12 chapters cover the substantive law of RICO. A chapter on the fundamentals of RICO interprets the elements of a RICO offense, i.e., "person," "the employment of a pattern of racketeering activity or the proceeds thereof," and the nature of an "enterprise." Also discussed are activities prohibited under RICO, injury, and sanctions and remedies. Chapters on the civil provisions of RICO address basic applications of the act, special problems, damages, and government civil RICO. Chapters on criminal RICO cover guidelines and applications as well as forfeiture. Practical guidelines for conducting civil RICO litigation encompass both plaintiffs' and defendants' tactics and strategy. Guidelines for conducting criminal RICO proceedings address prosecutors' considerations and defense techniques. A separate chapter covers parallel civil and criminal RICO proceedings. Appended supplementary material and a subject index
