THIS VOLUME SUMMARIZES THE INTIAL PHASE OF A PROJECT TO EXPLORE PROBLEMS AND IMPLICATIONS OF THE SUPREME COURT'S DECISION IN ARGERSINGER V HAMLIN (1972) AND TO PREPARE AND RECOMMEND SPECIFIC STRATEGIES FOR ITS IMPLEMENTATION.
Abstract
THE SECOND PHASE OF THE PROJECT WAS INTENDED TO TEST THE FEASIBILITY OF SOME OF THE MAJOR PROPOSALS OF THE FIRST PHASE IN SELECTED JURISDICTIONS. THE FINDINGS AND RECOMMENDATIONS RELEVANT TO A REVIEW OF PRACTICES AND PROCEDURES IN SELECTED JURISDICTIONS, IMPLICATIONS FOR THE LEGAL PROCESS, IMPLICATIONS FOR THE ROLE AND ENFORCEMENT OF CRIMINAL LAW, AND IMPLICATIONS FOR THE DEFENSE FUNCTION ARE SYNTHESIZED. AN APPENDIX CONTAINS THE FULL TEXT OF THE SUPREME COURT OPINION IN ARGERSINGER.
