Abstract
SYNOPSES OF TWO REPRESENTATIVE CASES INVOLVING VIOLATION OF MINORS' 'RIGHT TO TREATMENT' IN JUVENILE CORRECTIONAL FACILITIES AND OF THE REMEDIES OBTAINED BY THE COURTS ARE PRESENTED. FURTHER BACKGROUND ON THE JUVENILE'S RIGHT TO TREATMENT IS INCLUDED IN A CRITICAL EXAMINATION ON AND COMMENTARY OF THE MINIMUM STANDARDS FOR JUVENILES UNDER AUTHORITY OF THE TEXAS YOUTH COUNCIL IMPOSED BY ONE STATE COURT. PARTICULAR EXCEPTION IS TAKEN TO THE IDEA OF JUDICIALLY-MANDATED REQUIREMENTS. A REBUTTAL OF THIS VIEWPOINT IS FOLLOWED BY A DISCUSSION OF SOME CONCERNS ABOUT THE DIFFICULTY OF ADAPTING TRAINING SCHOOL PROCEDURES TO CONFORM WITH NEW JUVENILE LAWS. CONSIDERATION OF THE JUVENILE'S RIGHT TO EDUCATION (ESPECIALLY LITERACY EDUCATION) ALSO TOUCHES UPON HIS RIGHT TO BE PROTECTED FROM IQ TESTING AND POSSIBLE CLASSIFICATION BASED ON ITS RESULTS.
