ISSUES AND TRENDS IN JUVENILE LAW FROM THE DETECTION OF AN OFFENSE TO INSTITUTIONAL OR HOME PLACEMENT OF DELINQUENT YOUTHS AND CHILDREN BEYOND CONTROL.
Abstract
THE AUTHOR FOCUSES ON THE LEGAL PROTECTIONS ACCORDED TO CHILDREN IN THE INITIAL STAGES OF DELINQUENCY DETECTION, AND DURING INTAKE, DETENTION HEARINGS, JURISDICTIONAL HEARINGS (THE TRIAL STAGE), WAIVERS, DISPOSITIONAL HEARINGS, AND REVIEW AND APPEAL. ALSO DISCUSSED IS THE ATTORNEY'S ROLE IN THE JUVENILE COURT. THE AUTHOR'S POSITION IS THAT (1) THE FORMAL LEGAL PROCESS SHOULD BE USED ONLY AS A LAST RESORT, (2) THE RANGE OF CONDUCT CONSIDERED DELINQUENT SHOULD BE LIMITED, (3) ALTERNATIVES TO THE INSTITUTIONS AND OUT OF HOME PLACEMENTS SHOULD BE DEVELOPED AND UTILIZED, AND (4) THE CASES INVOLVING MORE SERIOUS OFFENDERS SHOULD INCLUDE ADJUDICATORY PROCEDURES CONSISTENT WITH BASIC PRINCIPLES OF DUE PROCESS.
