This report by the Center for Gender & Sexuality Law at Columbia Law School, presents Federal policy recommendations for addressing criminalization of LGBT (lesbian, gay, bisexual, and transgender) people and people living with HIV (PLWH). The recommendations are presented as a way to address the variety of criminal justice issues that impact LGBT people and PLWH. The report has six objectives: 1) guide Federal engagement with Federal, State, and local law enforcement agencies, jails, and prisons; 2) inform the implementation of the Prison Rape Elimination Act (PREA); advocate for additional reforms beyond PREA; 4) generate momentum around LGBT policy priorities; 5) highlight and address drivers of criminalization of LGBT people and PLWH; and 6) provide analysis that will serve as a resource for policy makers and advocates. The report is organized around six key topic areas: Policing and Law Enforcement; Prisons and Detention Centers; 3) Immigration-related issues; 4) Criminalization of Youth; 5) HIV Criminalization; and 6) Drivers of Incarceration. The recommendations presented in this report were the result of efforts by advocates, activists, and practitioners working with LGBT people and PLWH in the criminal justice system.
