DISCUSSION OF CRITERIA FOR CLASSIFYING AND PROSECUTING OFFENSES OF VIOLENT, DESTRUCTIVE, OR DISORDERLY BEHAVIOR UNDER THE CATEGORY OF 'HOOLIGANISM'.
Abstract
THE DIFFERENCE BETWEEN HOOLIGANISM AND OTHER OBJECTIVELY SIMILAR OFFENSES IS THAT HOOLIGANISM IS CONCEIVED OF AS HAVING A MARKEDLY ANTI-SOCIAL CHARACTER. THE AUTHOR SUPPORTS LEGISLATION ESTABLISHING THE OVERALL SOCIAL ORIENTATION OF THE OFFENDER AS THE BASIS FOR DETERMINING THE ANTI-SOCIAL CHARACTER OF THE OFFENSE. IN THIS SYSTEM, THE OVERALL SOCIAL ORIENTATION OF THE OFFENDER IS REFERRED TO AS HIS ATTITUDE AS OBJECTIVELY DESCRIBED, AS OPPOSED TO HIS SUBJECTIVE, CONSCIOUS MOTIVATIONS TO COMMIT THE OFFENSE.
