THE ROLES OF JUDGES, PROSECUTORS, AND DEFENSE ATTORNEYS IN THE POST-DISPOSITIONAL REVIEW OF CASES INVOLVING JUVENILES ARE DISCUSSED.
Abstract
A SUPERIOR COURT JUDGE ARGUES THAT JUDGES HAVE A CONTINUING RESPONSIBILITY AFTER PLACEMENT DECISIONS TO REVIEW THE EFFECTIVENESS OF THE CARE WHICH THEY HAVE ORDERED, AND THAT EACH STATE SHOULD HAVE A STATUTE MANDATING JUDICIAL REVIEW. THEN, A PRESIDENT OF THE NATIONAL DISTRICT ATTORNEYS ASSOCIATION SUGGESTS THAT PROSECUTORS SHOULD REPRESENT COURT SERVICES BEFORE THE COURT WHEN IT BECOMES CLEAR THAT A TREATMENT PROGRAM IS NOT FULFILLING THE COURT'S EXPECTATIONS. FINALLY, A STAFF COUNSEL FOR THE JUVENILE RIGHTS PROJECT OF THE AMERICAN CIVIL LIBERTIES UNION ARGUES THAT DEFENSE ATTORNEYS ALSO HAVE AN OBLIGATION TO SEE THAT PLACEMENT AGENCIES PROCEED WITH OCURT ORDERED SERVICES IN THE INTERESTS OF THEIR CLIENTS.
