Designed to aid defense attorneys representing juveniles accused of delinquent acts, this manual presents sample pleadings (request that the court take a particular action or enter a particular order) that cover client interviews; arraignment/detention; pretrial motions; transfer, waiver, certification, or jurisdictional hearing; adjudicatory hearing; dispositional hearing; modification of disposition; and appeals.
Abstract
For each pleading discussed there is a brief description of the associated form and when it is appropriate to use it, followed by the sample form itself. The attorney must adapt each form to the facts and circumstances of the specific case. Pleadings associated with client interviews are entry of appearance and release of information. Pleadings in the context of arraignment/detention are requests for various examinations of the client, bail, and habeas corpus. Pretrial motions cover request for discovery, bill of particulars, suppression, limiting testimony, severance of charges and codefendants, change of judge, change of venue, and continuance. Other motions are for transfer to juvenile court and to quash indictment in the criminal court. Motions associated with the adjudicatory hearing are those discussed for the pretrial period. Motions in the context of the dispositional hearing include a motion to modify the order of disposition, notice of appeal, motion to proceed as a poor person, motion for a free transcript, motion for a new adjudicatory hearing, and motion to expunge juvenile records.
