REPORT OF THE SCANDINAVIAN COMMITTEE ON CRIMINAL LAW CONCERNING THE DEDUCTION OF DETENTION TIMES PENDING INVESTIGATION FROM PRISON TERMS.
Abstract
THE SCANDINAVIAN COMMITTEE WAS SET UP IN 1960 WITH THE TASK OF EXPLORING ISSUES ON WHICH STATUTES COMMON TO ALL SCANDINAVIAN COUNTRIES COULD BE ENACTED. IN THE PRESENT REPORT, THE REDUCTION OF PUNISHMENTS TO ALLOW FOR TIME IN DETENTION PENDING INVESTIGATION BOTH BY COURTS IN PASSING SENTENCE AND BY CORRECTIONAL ADMINISTRATIONS IN EXECUTING THEM IS DEALT WITH. INFORMATION IS GIVEN ON APPLICABLE LAWS AND STATUTES IN THE INDIVIDUAL SCANDINAVIAN COUNTRIES, AND THESE LAWS AND STATUTES ARE COMPARED WITH EACH OTHER. THE ONLY SCANDINAVIAN COUNTRY THAT DID NOT PARTICIPATE IN THE WORK IN QUESTION WAS ICELAND. THE COMMITTEE PROPOSED THAT THE DEDUCTION OF DETENTION TIME - PENDING INVESTIGATION FROM PRISON TERMS BE MADE OBLIGATORY FOR ALL THE SCANDINAVIAN COUNTRIES. CONSEQUENTLY THE DEDUCTION OF DETENTION TIME FOLLOWING A COURT SENTENCE WOULD ALSO BE OBLIGATORY IN THE EXECUTION OF THE SENTENCE. --IN SWEDISH
