In this article, three issues on the research agenda of prison litigation are explored. They are: (1) judicial management, (2) compliance, and (3) legal impact.
Abstract
Judicial issues are questions concerning the effects of prison litigation on workload, court organization, judicial behavior, and related aspects of judicial process. Compliance issues are those issues which are raised by the reaction of corrections officials to court mandates. Impact issues concern secondary effects on the larger society and on the criminal justice system which are the result of prison litigation. The article evaluates work which has been done in these three areas and suggests avenues for future investigation for researchers and policy analysis. (Publisher abstract)
