DISCUSSION OF THE NATURE AND VARIETY OF THE PROBLEMS WHICH ARISE IN THE FIELD OF SEARCH AND SEIZURE, THEIR IMPORTANCE, AND THEIR IMPACT ON THE WORK OF THE COURT.
Abstract
THE FIRST SECTION OF THIS BOOK FOCUSES ON THE TEN SEARCH AND SEIZURE CASES DECIDED BY THE SUPREME COURT ON THE MERITS AT ITS 1972 TERM, BETWEEN OCTOBER 1972 AND JUNE 1973. CASES ARE SUMMARIZED AND EXAMINED TO SHOW THE KINDS OF QUESTIONS INVOLVED. THE SECOND SECTION OF THIS BOOK DEALS WITH THE MORE GENERAL PROBLEMS PRESENTED IN THE FIELD OF SEARCH AND SEIZURE, PARTICULARLY THE DILEMMA WHICH THE INCREASING NUMBER OF SUCH CASES RAISE FOR THE SUPREME COURT. THE AUTHOR SUGGESTS HAVING THE COURT CLASSIFY OR STANDARDIZE ITS DECISIONS IN THIS FIELD BY DEVELOPING CATEGORIES OR TYPE SITUATIONS WITH ESTABLISHED RULES APPLICABLE TO ALL CASES OF ONE TYPE. ALSO FAVORED WAS THE ESTABLISHMENT OF A NATIONAL PANEL OF THE UNITED STATES COURT OF APPEALS WHICH WOULD HANDLE, DIRECTLY FROM THE DISTRICT COURTS, THOSE CASES IN WHICH IT WOULD BE DESIRABLE TO HAVE A DECISION OF NATIONAL STANDING. CASES CITED ARE LISTED IN AN ALPHABETICAL TABLE AT THE END OF THE BOOK. AN INDEX IS ALSO PROVIDED.
