This guide provides trainers with a step-by-step discussion of each component of the Judicial Conference Committee on Criminal Law's Model Search and Seizure Guidelines, with emphasis on searches conducted by probation officers.
Abstract
Each chapter contains text designed to inform trainers of the legal and practical applications of a specific probation search topic. Where appropriate, case law is cited to support the information. The chapters address the plain view doctrine, the search condition, the reasonable suspicion standard, approval of searches, conduct of searches, consent search, and seizures. Each chapter identifies specific learning objectives; and several chapters include optional activities, such as scenarios and discussion questions trainers can use to enhance class discussion and build on participants' understanding of the topic. The information in the guide is not prepared in a lesson-plan format, since the guide's intent is to assist trainers with the preparation of an instruction format for presenting search and seizure issues. Appendixes contain synopses of Griffin v. Wisconsin and U.S. v. Gianetta, which are important decisions regarding probation searches, as well as a paper on legal issues concerning search and seizure by Federal probation officers of probationers' residences and property; the Model Search and Seizure Guidelines are also appended, along with sample forms that address various search and seizure activities.
