ASSESSMENT OF THE IMPACT OF THE SUPREME COURT DECISION IN UNITED STATES V ROBINSON (1973) WHICH DEALT WITH THE QUESTIONS OF PERMISSIBLE EVIDENTIARY STANDARDS FOR AND INTENSITY OF WARRANTLESS SEARCHES INCIDENT TO ARREST.
Abstract
PREVIOUS COURT RULINGS ON SEARCH INCIDENT TO ARREST ARE REVIEWED TO DETERMINE THE CONSISTENCY OF THE ROBINSON RULING WITH PAST COURT DEVCISIONS. THE AUTHOR CONCLUDES THAT THE RULING IS CONSISTENT WITH PRIOR COURT PRECEDENT AND SOUND AS A MATTER OF POLICY.
