THIS POLICE LEGAL TRAINING BULLETIN DISCUSSES THE LAW PERTAINING TO VEHICLE SEARCHES OTHER THAN CONSENTUAL AND INVENTORY SEARCHES.
Abstract
COVERED ARE VEHICLE SEARCHES CONNECTED WITH AND MADE AT THE SCENE OF A CUSTODIAL ARREST AND WITH PROBABLE CAUSE, SEARCHES INVOLVING CUSTODIAL ARREST WHERE THERE IS NO PROBABLE CAUSE TO SEARCH, NON-CUSTODIAL ARRESTS, STOPPING SUSPICIOUS PERSONS, SITUATIONS REQUIRING A WARRANT, PLAIN VIEW, AND THE FINDING OF INCRIMINATING ITEMS OTHER THAN THOSE SOUGHT. CERTAIN SPECIAL PROBLEMS INVOLVING VEHICLES OTHER THAN AUTOS, FORFEITURES, VEHICLES AS INSTRUMENTALITIES OR EVIDENCE, AND ABANDONED AND STOLEN VEHICLES ARE ALSO CONSIDERED.
