Section 1952 B of the Federal Comprehensive Crime Control Act of 1984 creates a new offense of violent crimes in aid of racketeering, aimed at murders and other violent crimes committed by organized crime members who do not travel interstate or use interstate facilities in the commission of the crime or who may not act for money or other direct pecuniary benefit. Section 1952 B thus addresses violent crimes committed in order to gain entrance to or secure or advance a position in a criminal enterprise.
Abstract
Section 1952 B requires approval in advance for the U.S. Department of Justice before it can be invoked by State and local law enforcement officials. The elements of violent crime in aid of racketeering and specific sanctions are set forth in the discussion of the statute. 25 footnotes.
